1. Who are we?
FightFanatic is a trading name of MF Appel Trading. Through our online store, we sell combat sports equipment and related products to consumers.

2. Applicability
These terms and conditions apply to the use of our online store and to agreements entered into between you and us through FightFanatic.
Mandatory consumer rights always apply. If any provision of these terms conflicts with them, statutory consumer protection takes precedence.
3. Products and product information
We do our best to display products, images, colours, sizes, specifications, stock levels and other information as accurately as possible. Colours and the appearance of a product may differ slightly on a screen from the actual product.
Obvious typographical, pricing or input errors are not binding on us. If such an error is discovered after you have placed an order, we will contact you and refund any amount already paid if the order cannot be fulfilled.
4. Orders and formation of the agreement
You place an order by completing the checkout process in our online store. After placing your order, you will receive an electronic confirmation.
We may refuse or cancel an order where there is a reasonable basis to do so, for example if a product unexpectedly becomes unavailable, payment cannot be processed, there is an obvious error, or there is reasonable suspicion of fraud or misuse.
If we cancel an order that has already been paid for, we will refund the relevant amount using the original payment method.
5. Prices and payment
Prices shown to consumers are in euros and include applicable VAT unless clearly stated otherwise. Any shipping charges or other costs that depend on your order will be shown before you finally place the order.
You can pay using one of the payment methods available at checkout. Additional terms of the relevant payment service may apply to certain payment methods.
Promotions, discounts and offers may be subject to additional terms. If separate terms are stated for a specific promotion, those terms apply in addition to these terms and conditions.
6. Shipping and delivery
We deliver in accordance with the shipping options, costs and estimated delivery times shown at checkout and in our shipping policy .
We do our best to process and deliver orders within the stated timeframe. Delays may occur during exceptionally busy periods, public holidays or circumstances beyond our reasonable control.
For consumer orders, we remain responsible for the product until you, or a third party designated by you, have received it, except where you choose a carrier that we do not offer as a delivery option and the law provides otherwise.

7. Retention of title
Where relevant, the delivered product remains our property until the full amount due for the order has been paid.
8. Right of withdrawal, returns and exchanges
Statutory withdrawal rules apply to online purchases. In addition, under the conditions of our returns policy, we offer a return period of up to 30 days.

Our additional return option does not affect any statutory rights you have as a consumer.
9. Warranty and defective products
You are entitled to a product that meets what you may reasonably expect from it and what we have promised about it. The statutory guarantee and any other statutory rights relating to defective products remain fully applicable.
Is a product defective, damaged or incorrectly delivered? Please contact us via our contact page. We will assess the issue and, depending on the circumstances and your statutory rights, provide an appropriate solution.
Any manufacturer’s or commercial warranty is additional to the statutory guarantee and does not limit your statutory rights.
10. Gift cards, promotions and discounts
Separate terms may apply to gift cards, discount codes and other promotions, for example regarding validity periods, whether they can be combined and which products are eligible.
Promotional terms never limit your statutory consumer rights.
11. Use of the website
You may not use our website for unlawful purposes, fraud, misuse, distributing malicious software or activities that interfere with the operation or security of our online store.
We may restrict access to certain functionality where reasonably necessary for security, maintenance, fraud prevention or the proper operation of our services.
12. Intellectual property
The content of our website, including text, design, images and other content, may be protected by copyright, trademark rights or other intellectual property rights belonging to FightFanatic or third parties.
You may view and use this content for personal use. Without permission, you may not systematically copy, publish, sell or commercially exploit protected material, except to the extent permitted by law.
Third-party brand names, logos and product images remain the property of their respective rights holders.
13. Third-party services and links
Our online store uses third-party service providers, for example for payments, shipping and technical services. We may also link to third-party websites or services.
For services provided directly to you by a third party, that third party’s terms and privacy policy may apply. We are not responsible for the content of third-party websites over which we have no control.
14. Privacy and cookies
We process personal data in accordance with our privacy policy. It explains what data we process, why we process it and what rights you have.

15. Liability
We are liable to the extent required by law. Nothing in these terms limits or excludes liability where doing so is not permitted under mandatory law.
To the extent permitted by law, we are not responsible for damage caused solely by incorrect or improper use of a product, normal wear and tear, failure to follow use or maintenance instructions, or modifications made to the product for which we are not responsible.
We are also not liable for temporary unavailability or delays caused by circumstances beyond our reasonable control, without affecting any statutory rights you may have as a result.
16. Force majeure and circumstances beyond our control
If we are temporarily unable to perform, or cannot perform on time, due to circumstances reasonably beyond our control, we will try to inform you as soon as possible.
If the delay or inability to perform gives you the right under the law to terminate the agreement or exercise other rights, those rights remain fully intact.

If you have a complaint about a product, order or our services, please contact us via our contact page. We will try to resolve complaints as quickly as possible and in consultation with you.
18. Governing law and disputes
Agreements with FightFanatic are governed by Dutch law.
This choice of law does not deprive a consumer residing in another country of the protection of mandatory consumer rules to which that consumer is entitled under applicable international law.
If we cannot resolve a dispute together, it may be submitted to the court with jurisdiction under the law. Consumers’ statutory rights regarding the competent court remain unaffected.
19. Changes to these terms
We may amend these terms and conditions from time to time, for example due to changes in our working practices or laws and regulations.
As a general rule, an order is governed by the terms in force at the time you placed the order. New terms do not apply retroactively to agreements already concluded, unless required by law or the change is solely to your benefit.
20. Severability
If any provision of these terms is found to be wholly or partly invalid or unenforceable, the remaining provisions remain in force. The relevant provision will only be disapplied to the extent necessary.
